Jeceriel Matillano Parreno, twenty-seven years old, single, and a resident of Villa Cecelia Subdivision, Abangay, Pototan Iloilo. He was arrested on a checkpoint in Nabitasan, La Paz, Iloilo City, last December 31, 2015 at 10:30 in the evening. The said Checkpoint was conducted by the La Paz PNP headed by PSI Raymund Deligro, Duty Officer together with his men which is composed of Senior Police officer II Virgil Silva, Police officer I Jan Joseph Bosque, Police officer III Jerome Digcabon, and Police officer I Rey Edward Amihan. The arrested person, violated Republic Act 4136 which is known as the Land Transportation and Traffic Code and RA 9165 which is also known as the Comprehensive Dangerous Drugs Act of 2002.
The arrest person was caught riding a black Sky Go King Motorcycle without a plate number, and when the policemen asked for his driver’s license, he also failed to present the said driver’s license, and during the verification of the official receipt (OR), car registration (CR), of his motorcycle, the said driver simply Dropped his improvised three water pipes later marked as “JPM-1”, “JPM-2”, and “JPM-3”, hence the said personnel placed him under arrest and incidental to a lawful arrrest. The term ‘lawful arrest’ refers to a legal principle that allows police to perform a warrantless search of an arrested person, in the interest of officer safety, the prevention of escape, and the destruction of evidence custody of a person under warrant or under a probable cause. Probable cause includes the belief of commission of crime, or an arrest demanded under civil process. One elongated heat sealed transparent plastic sachet containing white crystalline substance which the police believed to be “Shabu”. Shabu is a slang term for a drug which is a mixture of methamphetamine and caffeine prevalent throughout Asia. The said shabu was recovered from the right pocket of his short pants, which is later marked as “JPM-4”.
Initial inventory and marking was done at the La Paz police station in the presence of elected public official Brgy. Captain Barbara Joyce Aroza of Brgy. Nabitasan, La Paz, Iloilo City and media representative Peter Bayasca of Bombo Radyo. The final inventory was conducted with Duty Prosecutor Victoria Heler as witness.
Jeceriel Matillano Parreno was apprised of his constitutional rights and presently detained at the said station for proper disposition of his case or for a final settlement or determination. Exhibit as mentioned drug was submitted to PNP Crime Laboratory for laboratory examinations and non-drug items C/O ICPS2 exhibit custodian for proper disposition.
